Gari Bhara: Comprehensive Rental Terms & Conditions

At Gari Bhara, we believe in transparent and fair rental practices. Please take a moment to carefully read our terms and conditions before proceeding with your booking. By renting a car, bike, or scooter from us in Guwahati, you agree to abide by these terms, which are designed to ensure a smooth, safe, and enjoyable experience for all our customers, in compliance with Indian laws and regulations.

All bookings are subject to vehicle availability and confirmation by Gari Bhara. A valid booking confirmation will be sent to your registered email address.

  • Pricing: All rental prices displayed are inclusive of applicable taxes (GST) unless explicitly stated otherwise. Additional charges may apply for extra kilometers, extended rental periods, or specific add-on services.
  • Payment Methods: We accept major credit/debit cards, UPI, and net banking. Full payment for the rental period is required at the time of booking.
  • Security Deposit: A refundable security deposit is mandatory for all self-drive rentals. The amount varies based on the vehicle type and rental duration. This deposit is collected at the time of pickup and will be refunded within 3-7 business days after the vehicle is returned in satisfactory condition, subject to inspection for damages or additional charges.
  • Minimum Rental Period: Our standard minimum rental period is 24 hours. Shorter durations may be available for specific vehicles or promotions, subject to different rates.

To ensure compliance with the Motor Vehicles Act, 1988, and for your safety, the following requirements apply:

  • Age Requirement: The renter and any additional drivers must be at least 21 years old at the time of rental.
  • Valid Driving License: A valid Light Motor Vehicle (LMV) driving license issued in India, held for at least one year, is mandatory. The license must be original and physically present at the time of pickup.
  • Identity & Address Proof: Renters must provide a valid Aadhaar Card and PAN Card for identity and address verification. These documents are crucial for the rental agreement.
  • International Visitors: For international renters, a valid International Driving Permit (IDP) along with their original national driving license and passport/visa is required.
  • Verification: Gari Bhara reserves the right to verify the authenticity of all documents. Rental may be denied if documents are found to be invalid or suspicious.

Renters are expected to use the vehicle responsibly and in accordance with all applicable laws:

  • Adherence to Laws: The renter must strictly adhere to all traffic laws, rules, and regulations as per the Motor Vehicles Act, 1988, and local Guwahati traffic police guidelines.
  • Geographical Limits: Our vehicles are primarily intended for use within Northeast India. Specific restrictions may apply to certain remote, high-risk, or politically sensitive areas. Please inform Gari Bhara if you plan to travel outside the specified region.
  • Prohibited Activities:
    • Sub-renting or lending the vehicle to unauthorized individuals.
    • Using the vehicle for commercial purposes (unless explicitly agreed upon for specific business rentals).
    • Engaging in illegal activities, racing, stunts, or off-roading.
    • Driving under the influence of alcohol or drugs.
    • Transporting illegal goods or hazardous materials.
    • Overloading the vehicle beyond its seating or weight capacity.
  • Vehicle Condition: The renter is responsible for maintaining the vehicle in good condition during the rental period.

Gari Bhara operates on a 'Full to Full' fuel policy:

  • The vehicle will be provided to you with a full tank of fuel at the time of pickup.
  • You are required to return the vehicle with a full tank of fuel.
  • If the vehicle is returned with less than a full tank, the cost of the missing fuel, calculated at prevailing market rates, plus a refueling service charge (e.g., ₹200-₹500) will be deducted from your security deposit.

We ensure our fleet is regularly serviced, but unforeseen circumstances can occur:

  • Minor Maintenance: For rentals exceeding 7 days, renters are responsible for basic checks like tire pressure and fluid levels.
  • Breakdowns: In the event of a mechanical breakdown, immediately contact Gari Bhara's 24/7 support. Do not attempt major repairs yourself. We will arrange for roadside assistance or a replacement vehicle if available.
  • Puncture/Flat Tire: The renter is responsible for fixing punctures or flat tires during the rental period.
  • Damage Due to Negligence: Any damage caused due to renter's negligence (e.g., driving through flooded areas, ignoring warning lights) will be borne by the renter, beyond standard wear and tear.

All Gari Bhara vehicles are covered by comprehensive insurance as per Indian motor insurance regulations. However, renter liability applies:

  1. Immediate Notification: In case of an accident, theft, or damage, immediately inform Gari Bhara's support team and the nearest police station. An FIR (First Information Report) is mandatory for insurance claims.
  2. Do Not Move Vehicle: Unless absolutely necessary for safety, do not move the vehicle from the accident spot until police and Gari Bhara representatives have assessed the situation.
  3. Renter's Liability: The renter is liable for:
    • Damages not covered by the insurance policy (e.g., damages due to driving under influence, unauthorized usage).
    • The difference between the actual repair cost and the insurance claim amount (deductible/excess clause).
    • Loss of use charges for the period the vehicle is under repair.
    • Any damages or losses incurred due to violation of rental terms or negligence.
  4. Third-Party Damage: Liability for third-party damages is subject to insurance policy terms and applicable laws.

We understand plans can change. Our policy is as follows:

  • Cancellation Policy:
    • 24+ Hours Notice: Full refund (minus a small processing fee, if any).
    • Less than 24 Hours Notice: A portion of the rental fee (e.g., 1-day rental charge) may be non-refundable.
    • No-Shows: No refund will be provided for no-shows.
  • Modifications: Rental period extensions or modifications are subject to vehicle availability and may incur additional charges. Please notify us in advance.
  • Refund Processing: Refunds are processed to the original payment method within 5-10 business days after approval.
  • Gari Bhara Right to Cancel: Gari Bhara reserves the right to cancel a booking if the renter fails to meet eligibility criteria or violates any terms.

The renter is solely responsible for all traffic violations and associated fines incurred during the rental period:

  • Traffic Fines: This includes speeding tickets, parking fines, toll violations, and any other penalties issued by traffic authorities (e.g., Assam Police, RTO).
  • Late Return: Vehicles returned after the agreed-upon time will be subject to late return charges, typically calculated on an hourly or daily basis.
  • Cleaning Charges: Excessive dirtiness, smoking in the vehicle, or damage to the interior may incur additional cleaning charges.
  • Legal Jurisdiction: Any disputes arising from the rental agreement shall be subject to the exclusive jurisdiction of the courts in Guwahati, Assam, India.
